02Notice procedure.
-
What to include in a takedown notice.
To be valid under the DMCA, your notice must include: (a) identification of the copyrighted work; (b) identification of the allegedly infringing material on Aperture, with enough detail for us to locate it; (c) your contact information; (d) a statement that you have a good-faith belief that use of the material is not authorized; (e) a statement under penalty of perjury that the information is accurate and you are authorized to act; (f) your physical or electronic signature.
-
Where to send it.
Email dmca@aperturedeck.com. Postal address available on request.
-
What we do.
Valid notices are processed promptly. We remove or disable access to the identified material and notify the user who posted it (if applicable). We do not pre-screen for copyright; we respond to valid notices.
-
Misrepresentation has consequences.
Knowingly false notices subject the sender to liability under 17 U.S.C. § 512(f). Submit responsibly.
03Counter-notice procedure.
-
If your content was removed in error.
You may submit a counter-notice. It must include: (a) identification of the removed material and its prior location; (b) a statement under penalty of perjury that you have a good-faith belief the removal was the result of mistake or misidentification; (c) your name, address, and phone number; (d) consent to the jurisdiction of the federal court for the district where you live (or, if outside the U.S., the Northern District of California); (e) consent to accept service of process from the original complainant; (f) your physical or electronic signature.
-
What happens next.
We forward the counter-notice to the original complainant. If they do not file a court action within 10-14 business days, we may restore the material. We are not arbiters of the underlying dispute.
04Repeat infringer policy.
-
Accounts of repeat infringers terminated.
Aperture terminates accounts of users who are determined to be repeat copyright infringers, in appropriate circumstances, in accordance with 17 U.S.C. § 512(i).
-
Curation pipeline integrity.
Images entering the Aperture deck pass through a curation review that confirms licensing status (typically CC-BY or compatible). Where a licensing question arises post-acquisition, we use the same removal process described above.
